I.INTRODUCTION

This case is before the court for determination on an Agreed Statement of Facts, Agreed Submission of Exhibits, and on briefs. The Plaintiff, Continental Casualty Company (“Continental”), filed its Petition for Declaratory Judgment on March, 13, 2007, through which it asks this court “to determine the rights, duties and legal relations of the parties” under an insurance policy it issued to the Defendant, Alabama Emergency Room Administrative Services, P.C.
