The plaintiff brought this action to recover damages from the defendant company for the injury done to plaintiff and his property by reason of the noxious gases generated in defendant’s mill, located very near by, and at some points adjoining, plaintiff’s land, and erected for the purpose of manufacturing commercial fertilizers.
