Appellant Nathaniel Davis drove to his ex-wife’s boyfriend’s place of work, ostensibly to talk with the latter. He was waiting in the parking lot adjacent to the work place when the boyfriend, Rhodes, approached afoot. According to the victim and a bystander, Davis made two passes at Rhodes with his automobile in an apparent at tempt to run over him. Failing in this attempt, Davis then parked the car, pulled a pistol, and, either just before or just after leaping from his automobile, shot at Rhodes, who by this time was running in the opposite direction.
