I. BACKGROUND

On October 16, 2008, Relator Glenda Martin filed a qui tam Complaint — on behalf of herself, the United States, and the State of Tennessee — against Defendant Life Care Centers of America, Inc., pursuant to the False Claims Act (“FCA” or “the Act”), 31 U.S.C. §§ 3729 et seq., and the Tennessee Medicaid False Claims Act (“TMFCA”), TenmCode Ann. §§ 71-5-181 et seq.
