We granted certiorari in this matter in conjunction with People v. Schneider, No. 99SC401, to review the question of when a defendant who has entered a guilty plea and been sentenced may withdraw that plea based upon newly discovered evidence.1 Under the test we set forth today in Schneider, *76625 P.3d 755, 761-762, 2001 WL 533456 (Colo.2001), we conclude that the trial court did not err when it denied Defendant's Crim. P. 85(c) motion for a new trial based on newly discovered evidence. Therefore, we affirm the judgment of the court of appeals in People v. Mason, 997 P.2d 1245 (Colo.App.1999).
