The Illinois and Michigan canal, extending from the Chicago river to Peru, was constructed by the State of Illinois and is managed by the appellants as a board appointed by the Governor. In 1889 the act authorizing the formation of sanitary districts was passed, and the appellee, the Sanitary District of Chicago, was organized under said act. It has constructed a drainage channel from said Chicago river to Lockport. This suit arises out of a contract between the canal commissioners and the sanitary district by which the sanitary district agreed to supply water to the canal. Some statement of…
