The defendant was indicted for forging the receipt of one Benjamin Richardson, and being found guilty on a trial had, October term, 1807, before Thatcher, J., he moved the Court to set aside the verdict, on the ground that he was improperly convicted. Upon this motion, the cause has stood over to this term, when the following opinion was delivered by

It is not suggested that the judge admitted any witness who was objected to as incompetent, or that he misdirected the jury in a matter of law, or that the verdict was against the weight of the evidence.
Richardson, whose receipt the defendant is charged with forging, *201was sworn as a witness, and as he could neither gain or lose by the event of the trial, as it then appeared, he was properly admitted.
