OPINION
HOFFMAN, Senior Judge.
Defendant-Appellant Gary Common Council appeals the trial court's entry of partial summary judgment in favor of Plaintiff-Appellee Robert McCrady. We reverse.
McCrady presents two issues, one of which we will address first due to its subject matter. Restated, that issue is:
