GARWOOD, Circuit Judge:
Super Van, Inc. (Super Van) appeals the grant of summary judgment against it on res judicata grounds. We reverse and remand.

Defendant-appellee City of San Antonio (the City) regulates ground transportation 1 within its boundaries. Plaintiff-appellant Super Van operated a ground transportation service in San Antonio.
