Motion by the plaintiff, Hannah Walters, as administratrix, etc., of William Walters, deceased, for a new trial upon a case containing exceptions, ordered to be heard at the Appellate Division in the first instance, ujion a nonsuit granted by the court after a trial at the New York Trial Term.

Hatch, J.:

By this action the plaintiff seeks, in her representative capacity, to recover damages against the defendant for the claimed negligence of the latter in causing the death of plaintiff’s intestate. It appears from the testimony that the deceased was employed by the defendant about the construction of a building on the northwest corner of Wall and Water streets, in the borough of Manhattan. In the center of this building was placed a derrick, used in hoisting the iron work which entered into its construction. Deceased was one of the iron workers, and on the day when the accident…
