This appeal arose from the post-verdict revision of the jury’s award of damages to Appellee Robert McCullough. For the reasons stated below, we affirm the district court’s denial of Appellant Consolidated Rail Corporation’s motion to amend or alter the judgment.
FACTS
At the conclusion of the trial in this personal injury case, the jury was asked to answer six special verdict questions. During the course of deliberations, the jury sent out a note asking for clarification of Question 3 which read: “What was the total amount of damages sustained by plaintiff,…
