Error to the Court of Civil Appeals, Fourth District, in an appeal from Bexar County. Mary Brown and others sued the railway company and had judgment, which was affirmed on appeal by defendant, who thereupon obtained writ of error.

GAINES, Chief Justice.

This action was brought by the widow, the children, and the father and mother of William H. Brown to recover damages for injuries resulting in his death, alleged to have been caused by the negligence of the servants of the defendant railroad company.

There was a verdict and judgment in the plaintiff’s favor in the trial court, which judgment was affirmed upon appeal by the Court of Civil Appeals, one of the judges dissenting.

The deceased was the engineer upon a train of the defendant which was known as “No. 25,” and which left San Antonio at about 12:45 a. m. on December…
