OPINION
TENNEY, District Judge.
This action involves the defendants’ Pro Arts, Inc. (“Pro Arts”) and Stop and Shop Companies, Inc. (“Stop and Shop”) alleged infringement of the plaintiffs’ Factors Etc., Inc. (“Factors”) and Boxcar Enterprises, Inc. (“Boxcar”) exclusive right to exploit commercially the name and likeness of Elvis Presley.
