This is an original proceeding in this court on the part of Cas-tello Martin, relator, against E. I. O’Reilly, county judge of McIntosh county, Oklahoma, as respondent, praying that a writ of prohibition do issue. After notice so to do, the respondent has filed a response. The petition of„ the relator and the response of the respondent, without dispute, disclose that the relator is a Creek freedman, duly enrolled as such on the Creek freedman roll..
