This CPLR article 78 proceeding, transferred to this court, was brought to review a determination of respondents New York State Racing and Wagering Board, its Chairman and members. Petitioner was the driver of Cherokee Express, a horse that competed in, and won, by some three lengths, the eleventh race at Roosevelt Raceway on August 5, 1987.
