Appeal from a judgment of the Supreme Court (Lamont, J.), rendered April 9, 2004 in Albany County, convicting defendant upon his plea of guilty of the crime of attempted criminal sale of a controlled substance in the third degree.

Defendant was charged with criminal sale of a controlled substance in the third degree in connection with his sale of approximately 14 grams of cocaine to a confidential informant in exchange for $1,000 in cash.
