This is an appeal from a judgment rendered in a distress for rent action awarding plaintiff *370 in damages and from an order denying defendant’s motion for a rehearing. On appeal defendant contends: (1) that the action was initiated by plaintiff through a layman and therefore was a nullity, ab initio; and (2) that section 17 of “An Act to revise the law in relation to landlord and tenant” (hereinafter the “Distress for Rent Act”) (Ill.
