HIGGINS, Judge.

Ricky Lee Grubbs was convicted by a jury of capital murder, .§ 565.001, RSMo 1978 (repealed effective 10-1-84), and sentenced to death, § 565.008, RSMo 1978 (repealed effective 10-1-84). The ensuing judgment was affirmed. State v. Grubbs, 724 S.W.2d 494 (Mo. banc 1987), cert, denied, — U.S. -, 107 S.Ct. 3220, 96 L.Ed.2d 707 (1987). Grubbs subsequently made a collateral attack on his conviction under Rule 27.26 alleging ineffective assistance of counsel and instructional error.
