Affirmiug.

Obe Justice was an employee of tbe Lovell and Buffington Tobacco Company,, and while in its service bad bis band cut on a saw, sustaining a serious injury, to recover for wbicb be brought this suit. On a trial of tbe case be recovered $1,350. Tbe company appeals but does not complain of the amount of tbe verdict. It in*643sists that under the evidence the jury should have been instructed peremptorily to find for the defendant; that the court erred in admitting incompetent evidence, and that the court misinstructed the jury.
