This is an appeal by the plaintiff from an order made in a proceeding supplementary to execution, directing the sum of $760, deposited to defendant’s credit in the Bowery National Bank, to be paid over as follows : $35 to the referee for his services, $25 to plaintiff’s attorney, $276 to the respondent, Thomas Shiels, and the residue to the sheriff of the city and county of New York. The plaintiff, who has a judgment against the defendant, seeks by this proceeding to have it satisfied, out of the money deposited in the bank, to which claim is also laid by the respondents, Thomas Shiels and…
