Tompkins, J.:
This action was tried at a Trial Term in Westchester county in April, 1925, and a verdict rendered by the jury in favor of the defendant Frank Improvement Company, Inc., the complaint having been dismissed as to the other defendants. Immediately following the verdict, the plaintiff made the usual motion to set aside the verdict and for a new trial, which was denied.
