Plaintiff in error was indicted for malicious mischief in castrating a bull calf, the property of one Johnson. The indictment was under section 203 of Division 1 of the Criminal Code, which is as follows:

“Whoever wilfully and maliciously, kills, wounds, maims, disfigures or poisons any domestic animal, or exposes any poisonous substance, with intent that the life of any such animal should be destroyed thereby, such animal being the property of another, shall be imprisoned in the penitentiary not less than one, nor more than three years, or fined not exceeding $1,000 or both; Provided, that…
