Plaintiff in error, administrator of the estate of Helen M. Jones, his deceased wife, sued defendants in error Gibbs Brothers Company to obtain a judgment decreeing a deed by which Jones and his wife had conveyed to Gibbs Brothers Company the merchantable pine timber on a survey of land in Walker County to be no longer operative and removing from the title the cloud cast by the claim of defendants in error of the right to cut and remove the timber under said deed.
