It is assumed in the printed argument filed on behalf of the respective parties, that this action of forcible entry and detainer was commenced in a justice’s court by Pierce, the appellee, against Daniel Kendrick, Millard Kendrick and Temple Kendrick, and that Morris entered his appearance with the Kendricks before said justice. The record contains no transcript of proceedings in the justice’s court, and it is nowhere shown that any judgment was entered there, or any appeal taken.
