BAUER, Circuit Judge.

On November 8, 1993, Alfred Martin’s wife, Jacqueline, went to his apartment to ask whether he had bought their daughter a coat and to ask for money. Martin says that when he refused to give her money, Jacqueline started swinging at him. Martin says he grabbed her by her shoulders, turned her around and pulled her towards him; he was holding her with his left arm across her chest and right arm across her neck. They fell onto the couch and Jacqueline continued to kick and swing and Martin held her tight until she stopped moving.
