Plaintiff appeals from a judgment in favor of defendants granted *180by the District Court of the Second Judicial District, in and for the County of Silver Bow.

In February 1940, Helen C. Hodapp, one of the respondents, received legal title to a one-half interest in Lots 5, 6, 7, 8 and 9 in Block 5 of McQueeney’s Subdivision to the City of Butte, Montana, by distribution from the estate of her mother, Estelle Conroy.
