BERZON, Circuit Judge:
The United States Department. of Justice (DOJ) appeals the district court’s order that it produce two documents contained within the USABook, an internal DOJ resource manual for federal prosecutors, in response to the American Civil Liberties Union of Northern California’s (ACLU-NC) Freedom of Information Act (FOIA or “the Act”) request. The documents relate to DOJ’s use of. electronic surveillance and tracking devices in criminal investigations.
