CONNOR, District Judge.
This is an action on the case instituted in the circuit court of Wetzell county and removed into the Circuit Court of the United States for the Northern District of West Virginia. The purpose of the action is to recover damages sustained by the _ alleged negligence of- the plaintiffs in error, hereinafter called defendants, by the destruction of the property of defendant in error, hereinafter called plaintiff.
