On this appeal, plaintiff, Skaneateles Savings Bank (Bank), appeals from an order that denied its motion for summary judgment on the balance owed by defendants on a demand note. In reliance upon this Court’s decisions in Bank of N. Y. v Bersani (90 AD2d 302) and Mangno v Mangno (206 AD2d 936, lv dismissed in part and denied in part 85 NY2d 855), Supreme Court granted the cross motions of defendants to dismiss the complaint because the action was commenced more than six years from the date of the demand note, even though defendants had made payments on interest…
