The subject of contention in this case is the right of the plaintiff to occupy, with its railway, a part of a public road in Mifflin township between Pittsburg and Homestead. Both the parties are electric street railway companies. In the bill the plaintiff asked for an injunction to restrain the defendant from the construction of any electric road upon the part of the highway in question, and also to restrain any interference by the defendant with the construction of the plaintiff’s road.
