Appeal by the defendant from a judgment of the County Court, Rockland County (Kelly, J.), rendered February 27, 2002, convicting him of assault in the second degree, upon a jury verdict, and imposing sentence.
Ordered that the judgment is affirmed.
The defendant contends that the trial court should have dismissed three seated jurors who voiced possible biases after they were seated (see CPL 270.35 [1]). This contention is unpreserved for appellate review (see CPL 470.05 [2]; People v Pain, 298 AD2d 604 [2002]; People v Sell, 283 AD2d 920 [2001]). In any event, the contention is without merit,…
