JAMESON, District Judge.
This is an action to quiet title to the NW^NE^ of Section 36, Township 30 North, Range 8 West of the Montana Principal Meridian, in Glacier County, Montana. Plaintiff claims that it is the owner in fee simple and holds the land in trust for Mabel Pepion, an enrolled Indian of the Blackfeet Tribe. Defendants claim that John M. Angelí is the owner of the surface and C. E. Frisbee the owner of the minerals, through tax deed to Glacier County, Montana, and conveyances by Glacier County to Frisbee and by Frisbee to Angelí.
