GOODRICH, Circuit Judge.
Adolph Stanziale was inducted into the armed forces of the United States in January, 1943. On April 20, 1943, his wife, Ann Stanziale, filed a petition for a writ of habe-as corpus in the District Court of New Jersey, averring that her husband had been inducted as a result of the arbitrary and capricious action of his Local and Appeal Boards. The substance of the petition was that Stanziale should have been given a deferred classification by reason of dependency.
