Appellee Texas Department of Human Services (the “Department”) formerly administered the Texas Medical Assistance Program (“Medicaid”), which includes a reimbursement program for Medicaid hospitals serving a disproportionate share of low-income patients (“Dispro I program”). 1 Under the Dispro I program, Medicaid hospitals that serve the most low-income patients receive a pro rata share of an allotted fund which is disbursed annually.
