DOWD, Judge.

Movant, Raymond Milentz, appeals an order of the Circuit Court denying his motion to vacate judgment pursuant to rule 27.26.

Movant was convicted by jury of striking a police officer, § 557.215 RSMo 1969, and sentenced by the court to 5 years in the Missouri Department of Corrections. The conviction was affirmed by this court on direct appeal. 521 S.W.2d 1 (Mo.App.1975). Movant subsequently filed a 27.26 motion alleging, inter alia, that 1) he was denied effective assistance of counsel because trial counsel failed to call four material witnesses; 2) he was denied a fair trial…
