Appeal from judgment on report of referee. Action by Jackson W. Bowdisb, as assignee for benefit of creditors of Mortimer Allison and Lawrence Allison, against Esek Page, William H. Murray, and the Citizens’ National Bank of Hornellsville, for conversion. There was a judgment in favor of plaintiff, and defendants appeal. Reversed.

The plaintiff, as assignee for the benefit of creditors of Mortimer Allison and Lawrence Allison, seeks to recover for the alleged conversion of a quantity of boots and shoes. The defendants alleged by way of justification that the property was taken by virtue of an execution issued upon a judgment in favor of the defendant bank against Isaac Allison, and that the title was then in him. It appears that Isaac Allison was engaged in the business of manufacturing boots and shoes at Canisteo, N. Y.; that he became indebted to Mortimer and Lawrence Allison, who were in the business of banking in…
