INTRODUCTION

The history of this action is set forth in detail in this Court’s prior decision, Long Island Lighting Co. v. Transamerica Delaval, Inc., 646 F.Supp. 1442 (S.D.N.Y.1986) (“LILCO I’), familiarity with which is assumed. Defendant Transameriea De laval, Inc. recently changed its name to Imo Delaval, Inc., and shall be refered to herein as “Delaval.”
