Upon a jury trial in the circuit court of Henry county the defendant, Joe Arcabascio, was found guilty of the murder of his son-in-law, Claude Schuldt, and his punishment fixed at imprisonment in the penitentiary for a term of fourteen years. Motion for a new trial and in arrest of judgment was overruled and judgment entered upon the verdict. Defendant now seeks a reversal claiming the evidence was not sufficient to establish his guilt beyond a reasonable doubt and that prejudicial error was committed by the trial court in the giving of certain instructions, rulings upon the evidence and…
