This case was tried by the district court of Travis county and judgment rendered and notice of appeal given on the 14th day of December, 1911, and on the same day the court made an order allowing plaintiff 60 days after the final adjournment of the term within which to file the statement of facts and bills of exception. The court adjourned for the term on the 23d day of December, 1911, and on February 17, 1912, at a subsequent term, the court ’ extended the time for filing said statement, of facts and bills of exception 30 days beyond the time allowed by the order of December 14, 1911.
