McGEE, Judge.

This cases arises from a farm accident that resulted in the death of plaintiff’s intestate. The record in this case tends to show that plaintiff’s intestate and defendant Mark Bass were working together in October 1994 picking cotton on a farm in Duplin County. At the time of the accident, defendant was operating a cotton picker, moving it forward as it dumped cotton into a metal trailer adjacent to the cotton picker.
