In an action, inter alia, to recover damages for breach of contract, defamation and invasion of privacy, the defendant Elephant Walk, Inc. appeals, as limited by its brief, from so much of an order of the Supreme Court, Kings County (Cohen, J.), dated September 27, 1988, as denied its motion to dismiss the third cause of action asserted in the plaintiffs verified complaint and granted that branch of the plaintiff’s cross motion which was for leave to serve an amended complaint.

Ordered that the order is reversed insofar as appealed , from, on the law, without costs or disbursements, the motion…
