On the 6th day of February, 1871, Peter G. Flinn became the purchaser of a tract of land in Grant county, at a sale of lands in that county for de*574linquent taxes. On the 9th day of March, 1874, he surrendered his certificate of purchase to the auditor of the county, and received a deed from the auditor for said tract of land. On the 1st day of December, 1877, the said Flinn commenced this suit against Jonathan ~W. Parsons, administrator of the estate of Andrew F.
