delivered the opinion oe the court.
On the 18th of May, 1866, the judgment confirming the master’s report and adjudging to Finnell & Winston certain amounts against the executrix and her surety was rendered, which judgment is found commencing on page 62 of this record. On the 14th of May, 1868, a second judgment was rendered on the same record in favor of McClure & Keen. No appeal was prayed from either of said judgments in the court below; but a transcript of the record was filed in the office of the clerk of this court on the 28th of January, 1869, and an appeal allowed by him.…
