The appeal in this case is from the Jef-. ferson county circuit court, and is governed, by the Jefferson County Practice Act (Acts 1888-89 pp. 797, 800 § 7 et seq.).
The decisions of this court, as well as those of the Supreme Court, are to the effect that the Local Practice Act controls to the exclusion of the general statutory provisions embraced in section 9502 of the Code 1923.
