This case is an action by a servant against his master for damages for personal injuries. The parties will be designated here as plaintiff and defendant as they were in the trial court.

The defendants, the Sternbergs, were, at the time of the accident, engaged in the business of excavating a drainage canal in Mississippi county, Arkansas. The work was done by means of a dredge. A dipper attached to a long arm, or boom, scoops out the dirt, is then swung to the bank and there emptied.
