This is an action for divorce, alimony and custody of minor children. The probate court of Hamilton county, where the action was filed, made, in the absence of the district judge, an ex parte order for custody of the children and for alimony. The defendant appeared specially and filed a motion to dissolve this order on the ground that plaintiff was not a bona fide resident of the county where the action was filed, and the probate court had no jurisdiction to make the order, nor did the district court of that county have jurisdiction of the…
