Burwell, J.:
Collins and Wallace filed their petition in the district court of Pawnee county praying that certain taxes assessed and levied against their cattle in the Osage Indian reservation be enjoined for the reason that the 'Sanie was illegal and void. To this petition the defendants demurred. The court sustained the demurrer and the plaintiffs having elected to stand on their petition, the court entered judgment denying the injunction and taxing the costs to the plaintiff.
