GLADNEY, Judge.

Virgil McNeely brings this action in tort to recover damages to his Chrysler automobile incurred in an accident on September 10, 1952, when it struck the rear of a Ford automobile belonging to T. T. Tumminello, the defendant’s insured.

At the time of the accident, about mid-afternoon with clear weather, Martha McNeely, who was then about fourteen or fifteen years of age, was driving her father’s automobile and Toinette Tumminello, a young lady of approximately the same age as Martha, was driving the Ford automobile.
