Mrs. Georgia May Patterson, sued Louisville & Nashville Railroad Company in the Superior Court of Murray County for damages for the homicide of her husband, who was killed when a truck operated by him was struck by one of the defendant’s passenger trains at a private crossing. The plaintiff alleged, substantially?, that the defendant was negligent as .a matter of fact: (1) in failing to use ordinary care to anticipate the presence of the plaintiff’s husband upon said crossing at the time; (2) in failing to exercise ordinary care to avoid doing injury to the plaintiff’s husband…
