MEMORANDUM OPINION

GRADY, District Judge.

Before the court is defendants’ motion to dismiss the complaint. For the reasons stated in this opinion, the motion is granted in part and denied in part.

BACKGROUND

Dale Miller was a pretrial detainee at the Cook County Jail during the time relevant to this lawsuit, which he brings under 42 U.S.C. § 1983 against J.W.
